Cette acceptation se mat\u00e9rialise par un clic de validation lors de son inscription sur le Service.<!-- Est-ce applicable\u00a0? --><\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA se r\u00e9serve la possibilit\u00e9 de modifier les pr\u00e9sentes CGU Propri\u00e9taires. Toute modification prendra effet dans le d\u00e9lai de 72 heures \u00e0 compter de la modification. Elles ne s&rsquo;appliqueront pas pour les transactions en cours au moment de leur entr\u00e9e en vigueur.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA met \u00e0 la disposition les pr\u00e9sentes CGU Propri\u00e9taires \u00e0 l\u2019adresse suivante https:\/\/grintoura.fr\/cgv-grintoura-proprietaire\/&nbsp;<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Chaque Propri\u00e9taire s\u2019engage \u00e0 les consulter r\u00e9guli\u00e8rement pour rester inform\u00e9 de toute \u00e9ventuelle mise \u00e0 jour.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA n\u2019autorise aucune personne \u00e0 s\u2019inscrire sur ce Site \u00e0 moins qu&rsquo;elle n\u2019ait la capacit\u00e9 juridique n\u00e9cessaire de conclure des contrats juridiquement contraignants. Chaque Propri\u00e9taire d\u00e9clare et certifie que toutes les informations qu\u2019il soumet au Site dans le cadre de son inscription sur le Site en qualit\u00e9 de Propri\u00e9taire sont v\u00e9ridiques et exactes. En outre, chaque Propri\u00e9taire convient d\u2019informer rapidement le Site si ses coordonn\u00e9es ont chang\u00e9 et diff\u00e8rent de celles pr\u00e9c\u00e9demment fournies sur le Site.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les droits et obligations qui d\u00e9coulent de la relation entre GRINTOURA et le Propri\u00e9taire sont personnels, incessibles et non transf\u00e9rables.<\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"western\" align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">1. OBJET<\/span><\/span><\/h3>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les pr\u00e9sentes CGU Client ont pour objet de d\u00e9finir les conditions dans lesquelles GRINTOURA met \u00e0 la disposition des Clients, sur le Site, les outils technologiques leur permettant de louer des biens immobiliers propos\u00e9s par les Propri\u00e9taires. <\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans ce cadre, il est rappel\u00e9 que GRINTOURA intervient en tant qu\u2019op\u00e9rateur de plateforme num\u00e9rique, comme simple interm\u00e9diaire. Son r\u00f4le est limit\u00e9 \u00e0 l\u2019h\u00e9bergement des Annonces qualifi\u00e9es sur le Site et \u00e0 la mise en relation des Clients avec les Propri\u00e9taires.&nbsp;<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA n\u2019est pas un organisateur ou un d\u00e9taillant de voyages \u00e0 forfait au sens de la directive (UE) 2015\/2302 relative aux voyages \u00e0 forfait. Par ailleurs, GRINTOURA n\u2019agit pas en qualit\u00e9 de commer\u00e7ant aux fins de prestations de voyages li\u00e9es au sens de la directive (UE) 2015\/2302.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire est inform\u00e9 qu\u2019avec le Client, ils sont responsables de remplir leurs obligations en vertu du contrat qu\u2019ils ont conclu, et que GRINTOURA n\u2019est aucunement partie \u00e0 de tels contrats conclus entre le Client et le Propri\u00e9taire, et rejette toute responsabilit\u00e9 r\u00e9sultant de ces contrats m\u00eame si le Site facilite la r\u00e9servation d\u2019une location de biens immobiliers \u00e9tant donn\u00e9 que GRINTOURA n\u2019est partie \u00e0 aucun contrat de location ou autre entre un Client et un Propri\u00e9taire.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>2. DEFINITIONS<\/b><\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les termes indiqu\u00e9s par une Majuscule, ont la signification suivante dans les pr\u00e9sentes Conditions G\u00e9n\u00e9rales :<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Annonce<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>qualifi\u00e9e<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> \u00bb&nbsp;: d\u00e9signe l\u2019offre de location de biens immobiliers propos\u00e9e par le Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Bien immobilier<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;\u00bb&nbsp;: d\u00e9signe tout bien immobilier propos\u00e9e \u00e0 la location par le Propri\u00e9taire aux Clients via le Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Client&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe toute personne physique ou morale, acc\u00e9dant au Site et proc\u00e9dant \u00e0 la location d\u2019un bien immobilier propos\u00e9 par un Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Commande&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe la location d\u2019un ou de plusieurs biens immobiliers r\u00e9alis\u00e9e par un Client sur le Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Compte Propri\u00e9taire<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;\u00bb : d\u00e9signe l\u2019interface permettant notamment l\u2019acc\u00e8s au Propri\u00e9taire \u00e0 son espace priv\u00e9 en ligne, de le configurer et de suivre les Commandes effectu\u00e9es par les Clients. L\u2019acc\u00e8s au Compte Propri\u00e9taire se fait gr\u00e2ce \u00e0 des Identifiants.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Conditions de location<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;\u00bb : d\u00e9signe le contrat du Propri\u00e9taire encadrant la location du Bien immobilier entre le Propri\u00e9taire et le Client. Chaque Propri\u00e9taire fournit ses propres conditions de location afin d\u2019encadrer la location de ses Biens immobiliers par l\u2019interm\u00e9diaire du Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Contenus<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;\u00bb : d\u00e9signe l\u2019ensemble des informations, textes, logos, marques, animations, dessins et mod\u00e8les, photographies, donn\u00e9es, liens hypertextes, et de fa\u00e7on g\u00e9n\u00e9rale tous les \u00e9l\u00e9ments et contenus du Propri\u00e9taire publi\u00e9s sur le Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Etablissement de paiement<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;\u00bb d\u00e9signe la soci\u00e9t\u00e9 d\u00e9tentrice d\u2019un agr\u00e9ment bancaire, la soci\u00e9t\u00e9 STRIPE France, fournissant sur le Site des services de paiement aux Propri\u00e9taires, afin de leur permettre d\u2019encaisser les paiements des Clients. <\/span><\/span><\/p>\n<p align=\"justify\"><font face=\"Arial Nova Light, serif\" size=\"2\">La soci\u00e9t\u00e9 STRIPE France est une soci\u00e9t\u00e9 SARL&nbsp;unipersonnelle, au capital de mille euros, dont le si\u00e8ge social est situ\u00e9 10&nbsp;boulevard Haussmann 75009 Paris et immatricul\u00e9e au Registre du commerce et des soci\u00e9t\u00e9s de Paris sous le num\u00e9ro 807572011, habilit\u00e9e \u00e0 exercer son activit\u00e9 en France, en qualit\u00e9 d\u2019\u00e9tablissement de monnaie \u00e9lectronique agr\u00e9\u00e9 par l&rsquo;ACPR.<\/font><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Identifiants&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signent pour le Propri\u00e9taire, le login et le mot de passe d\u00e9finis lors de la cr\u00e9ation du Compte Marchand lui permettant d\u2019acc\u00e9der \u00e0 cet espace priv\u00e9.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Propri\u00e9taire&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe tout propri\u00e9taire de biens immobiliers ou leur repr\u00e9sentant, professionnel ou non, ayant souscrit aux Services propos\u00e9s par GRINTOURA et dont les Biens Immobiliers sont propos\u00e9s aux Clients sur le Site.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Services&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe l\u2019ensemble des services propos\u00e9s par <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><i> <\/i><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">aux Clients par l\u2019interm\u00e9diaire du Site et notamment la mise en relation des Clients avec les Propri\u00e9taires.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Site&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe la plateforme en ligne accessible \u00e0 partir du Site www.grintoura<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">.fr. Le Site est un espace sur lequel des Propri\u00e9taires proposent \u00e0 la location des Biens immobiliers, par l\u2019interm\u00e9diaire de GRINTOURA, agissant en tant qu\u2019op\u00e9rateur de plateforme en ligne (interm\u00e9diaire).&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Utilisateur&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe toute personne qui acc\u00e8de et navigue sur le Site, qu\u2019il soit Propri\u00e9taire, Client, ou simple internaute.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3. CONDITIONS D\u2019ACCES AU SITE<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout Utilisateur peut acc\u00e9der au Site et b\u00e9n\u00e9ficier des Services d\u00e9crits ci-apr\u00e8s.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span Compte Propri\u00e9taire, en renseignant les champs qui lui sont demand\u00e9s lors de la proc\u00e9dure d\u2019inscription.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Pour cr\u00e9er un Compte Propri\u00e9taire, l\u2019Utilisateur est invit\u00e9 \u00e0 fournir certaines informations telles que atteinte, \u00e0 quelque titre que ce soit, aux droits des tiers.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s\u2019engage \u00e0 ne cr\u00e9er qu\u2019un seul et unique Compte Propri\u00e9taire. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA d\u00e9cline toute responsabilit\u00e9 quant aux cons\u00e9quences dommageables que pourrait avoir l\u2019utilisation de Comptes Propri\u00e9taires multiples pour un seul Propri\u00e9taire.<\/span><\/span><\/p>\n<p align=\"justify\">\n<\/p><p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire est enti\u00e8rement responsable de l\u2019exactitude et de la mise \u00e0 jour des donn\u00e9es communiqu\u00e9es dans le cadre de l\u2019ouverture et de la gestion de son Compte Propri\u00e9taire.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire sera seul responsable de l&rsquo;utilisation de ses Identifiants ou des actions faites par l&rsquo;interm\u00e9diaire de son Compte Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans le cas o\u00f9 un Propri\u00e9taire divulguerait ou utiliserait ses Identifiants de fa\u00e7on contraire \u00e0 leur destination, <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> pourra alors suspendre l\u2019utilisation du Compte Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En aucun cas, GRINTOURA ne saurait \u00eatre tenu responsable en cas d\u2019usurpation de l\u2019identit\u00e9 d\u2019un Propri\u00e9taire. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout acc\u00e8s et action effectu\u00e9 \u00e0 partir du Compte Propri\u00e9taire d\u2019un Propri\u00e9taire sera pr\u00e9sum\u00e9 \u00eatre effectu\u00e9 par ce Propri\u00e9taire, dans la mesure o\u00f9 GRINTOURA n\u2019a pas pour obligation et ne dispose pas des moyens techniques lui permettant de s\u2019assurer de l\u2019identit\u00e9 des personnes ayant acc\u00e8s au Site \u00e0 partir d\u2019un Compte Propri\u00e9taire.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Toute perte, d\u00e9tournement, ou utilisation non autoris\u00e9e des Identifiants d\u2019un Propri\u00e9taire et leurs cons\u00e9quences rel\u00e8vent de la seule responsabilit\u00e9 du Propri\u00e9taire, ce dernier \u00e9tant tenu d\u2019en avertir le Site, sans d\u00e9lai, par courriel adress\u00e9 \u00e0 l\u2019adresse suivante&nbsp;: reclamations@grintoura.fr<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La cr\u00e9ation du Compte<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> Marchand, si n\u00e9cessaire, n\u00e9cessitera l\u2019ouverture d\u2019un compte au nom du Propri\u00e9taire aupr\u00e8s de l\u2019Etablissement de paiement du Site. Les conditions d\u2019utilisation de ce compte de paiement <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">sont d\u00e9finies dans les conditions g\u00e9n\u00e9rales d\u2019utilisation des services de paiement de l\u2019Etablissement de paiement, accessibles \u00e0 l\u2019adresse &nbsp;www.Stripe.fr qui seront communiqu\u00e9es lors du processus d\u2019inscription<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">. Le Propri\u00e9taire devra en prendre connaissance et les accepter. &nbsp;L\u2019adh\u00e9sion aux conditions d\u2019utilisation du compte de paiement est obligatoire dans le cadre de l\u2019utilisation des Services du Site.<!-- A valider --><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire recevra une r\u00e9ponse d\u00e9finitive sur son r\u00e9f\u00e9rencement dans un d\u00e9lai maximum de 15 jours ouvr\u00e9s \u00e0 compter de la date \u00e0 laquelle il aura communiqu\u00e9 l\u2019ensemble des pi\u00e8ces justificatives demand\u00e9es.&nbsp;GRINTOURA se r\u00e9serve le droit de refuser toute demande de r\u00e9f\u00e9rencement, et ce sans qu\u2019elle ait \u00e0 exposer les motifs de son refus.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Si l\u2019inscription du Propri\u00e9taire est valid\u00e9e, le Propri\u00e9taire pourra alors publier son Annonce qualifi\u00e9e sur le Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">A partir de son Compte Propri\u00e9taire, le Propri\u00e9taire g\u00e8rera toute son activit\u00e9 sur le Site, \u00e0 savoir la cr\u00e9ation de son Annonce qualifi\u00e9e et sa publication sur le Site, la mise \u00e0 jour des informations relatives aux Biens immobiliers, les informations sur le suivi des Commandes, son historique de location, entre autres. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans son Annonce qualifi\u00e9e, le Propri\u00e9taire s\u2019engage \u00e0 publier exclusivement des informations (descriptif du Bien immobilier, tarifs de location, taxes, et politique d\u2019annulation) exactes et \u00e0 jour, et il ne saurait appliquer aux Clients des conditions de r\u00e9servation ou de location diff\u00e9rentes de celles d\u00e9crites dans l\u2019Annonce. En cas de non-respect des obligations incombant au Propri\u00e9taire au titre des pr\u00e9sentes CGU Propri\u00e9taires, GRINTOURA se r\u00e9serve le droit d\u2019exclure le Propri\u00e9taire de fa\u00e7on d\u00e9finitive du Site.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Toute autre utilisation du Compte Propri\u00e9taire pour un motif non autoris\u00e9 par GRINTOURA est interdite.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Compte Propri\u00e9taire sera d\u00e9sactiv\u00e9 en cas de suspension et\/ou r\u00e9siliation des pr\u00e9sentes Conditions G\u00e9n\u00e9rales, selon les modalit\u00e9s d\u00e9finies \u00e0 l\u2019article 8.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>4. MODALITES FINANCIERES <\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>4.1 Frais de service<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Annonces qualifi\u00e9es sont cr\u00e9\u00e9es sans frais \u00e0 avancer mais seront, en contrepartie, factur\u00e9es d\u2019un montant incluant (i) une commission \u00e0 payer \u00e0 GRINTOURA \u00e9gale \u00e0 un pourcentage de 8 % du montant total de la location (y compris tous frais obligatoires factur\u00e9s par le Propri\u00e9taire) pay\u00e9 par le Client pour une Commande r\u00e9alis\u00e9e via le Site, et des frais de traitement du paiement relatifs au paiement en ligne, lesquels frais sont dus \u00e0 l\u2019Etablissement de paiement (ci-apr\u00e8s les Frais de service). GRINTOURA se r\u00e9serve le droit de modifier les Frais de service applicables, une telle modification devant \u00eatre notifi\u00e9e au Propri\u00e9taire au minimum 30 jours avant la date d\u2019entr\u00e9e en vigueur des nouveaux Frais de service. Le nouveau taux des Frais de service sera r\u00e9put\u00e9 accept\u00e9 si le Propri\u00e9taire ne retire pas son Annonce qualifi\u00e9e avant la date d\u2019entr\u00e9e en vigueur de la nouvelle Commission.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Frais de service applicables \u00e0 la publication d\u2019une Annonce qualifi\u00e9e seront d\u00e9taill\u00e9s avant la validation de la publication de l\u2019Annonce qualifi\u00e9e. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La collecte et le traitement des sommes pay\u00e9es par les Clients, sont g\u00e9r\u00e9s par l\u2019Etablissement de paiement. <!-- Est-ce la cas\u00a0? --><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire reconna\u00eet et accepte que GRINTOURA n\u2019intervient \u00e0 aucun moment dans le processus de paiement et d\u00e9cline par cons\u00e9quent toute responsabilit\u00e9 quant \u00e0 l\u2019exactitude du paiement de la Commande. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>4.2 Taxes \u00e0 la charge du Propri\u00e9taire<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire est seul responsable de d\u00e9terminer quelles sont ses obligations en termes de d\u00e9claration, de collecte, de versement ou d\u2019inclusion \u00e0 son Annonce qualifi\u00e9e de toute TVA ou autres taxes \u00e0 la consommation indirectes, taxes de s\u00e9jour, taxes de tourisme, taxes sur le chiffre d\u2019affaires brut, taxes fonci\u00e8res ou autres taxes factur\u00e9es aux visiteurs et taxes sur le revenu applicables (les \u00ab Taxes \u00bb). GRINTOURA ne fournit aucun conseil concernant les taxes.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La r\u00e9glementation fiscale peut imposer \u00e0 GRINTOURA de recueillir des informations fiscales aupr\u00e8s des Propri\u00e9taires et\/ou de pr\u00e9lever des taxes sur les montants vers\u00e9s aux Propri\u00e9taires. Si un Propri\u00e9taire ne fournit pas les documents n\u00e9cessaires pour permettre \u00e0 GRINTOURA de r\u00e9pondre \u00e0 ses \u00e9ventuelles obligations, GRINTOURA serait alors autoris\u00e9 \u00e0 pr\u00e9lever lesdites taxes jusqu\u2019\u00e0 ce que l\u2019information lui ait \u00e9t\u00e9 fournie.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">4.3 Taxes sur les Frais de service<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire est responsable de tous frais relatifs \u00e0 ses Biens immobiliers et ses Annonces qualifi\u00e9es, et doit rendre compte aupr\u00e8s de toute autorit\u00e9 concern\u00e9e de toutes taxes applicables (y compris, le cas \u00e9ch\u00e9ant, notamment la TVA) aux paiements qu\u2019il re\u00e7oit de la part des Clients. GRINTOURA peut \u00eatre dans l\u2019obligation de collecter et de reverser des taxes (y compris la TVA, et d\u2019autres taxes \u00e9quivalentes) sur les Frais de service factur\u00e9s aux Propri\u00e9taires. S\u2019il y est requis, GRINTOURA enverra au Propri\u00e9taire une facture indiquant le montant des taxes factur\u00e9es sur de tels Frais de service. Si le Propri\u00e9taire est en droit de b\u00e9n\u00e9ficier d\u2019une exon\u00e9ration de taxes sur les Frais de service, il doit fournir \u00e0 GRINTOURA les justificatifs d\u2019une telle exon\u00e9ration.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">4.4 Taxe de s\u00e9jour<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Conform\u00e9ment \u00e0 l\u2019article L2333-33 du Code g\u00e9n\u00e9ral des collectivit\u00e9s territoriales, GRINTOURA collectera la Taxe de s\u00e9jour.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire convient que GRINTOURA pourra lui demander de verser des montants suppl\u00e9mentaires au cas o\u00f9 la Taxe de s\u00e9jour collect\u00e9e et \/ ou revers\u00e9e est insuffisante pour le lib\u00e9rer pleinement de ses obligations envers l\u2019Administration fiscale.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s\u2019engage express\u00e9ment \u00e0 lib\u00e9rer, d\u00e9fendre et indemniser et tenir indemne GRINTOURA et ses dirigeants, en cas de r\u00e9clamations, responsabilit\u00e9s, dommages, pertes, dettes, obligations et frais, y compris, sans restriction, tous frais juridiques et \/ ou de comptabilit\u00e9 raisonnables, r\u00e9sultant ou associ\u00e9s de quelque mani\u00e8re que ce soit au non-respect ou \u00e0 la violation de la l\u00e9gislation en mati\u00e8re des Taxes de s\u00e9jour.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Propri\u00e9taires donnent le droit \u00e0 GRINTOURA, sans autre forme de notification, d\u2019enregistrer, de transf\u00e9rer et de divulguer \u00e0 l\u2019Administration fiscale des donn\u00e9es et d\u2019autres informations \u00e0 leur sujet ou relatives \u00e0 leurs transactions, r\u00e9servations, s\u00e9jours ou Taxes de s\u00e9jour, y compris, mais sans s\u2019y limiter, des informations telles que le nom du propri\u00e9taire, l\u2019adresse du Bien immobilier, les dates et montants des transactions, un ou des num\u00e9ros d\u2019identification fiscale, le montant de taxes collect\u00e9 aupr\u00e8s des Clients, les coordonn\u00e9es personnelles et d\u2019autres informations similaires, et ce afin de se conformer \u00e0 une demande valide.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>5. NATURE DES SERVICES PROPOSES AUX PROPRIETAIRES<!-- Est-il pr\u00e9vu la possibilit\u00e9 de mettre des avis\u00a0? Est-ce \u00e9galement le cas sur Grinmarket\u00a0? --><\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Services propos\u00e9s par GRINTOURA aux Propri\u00e9taires par l\u2019interm\u00e9diaire du Site sont les suivants :<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le \u00ab Service \u00bb : c\u2019est-\u00e0-dire le Service principal fourni par GRINTOURA consistant en la mise \u00e0 disposition de la solution num\u00e9rique g\u00e9n\u00e9rant le Site qui permet au Propri\u00e9taire de cr\u00e9er son Compte Propri\u00e9taire, d\u2019y importer les Biens immobiliers qu\u2019il souhaite louer, d\u2019\u00eatre mis en relation avec le Client et de lui louer les Biens immobiliers gr\u00e2ce aux services de paiement fournis par l\u2019Etablissement de paiement.<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les \u00ab Services de paiement \u00bb : c\u2019est-\u00e0-dire les solutions de paiement et les services de paiement associ\u00e9s fournis par l\u2019Etablissement de paiement permettant aux Propri\u00e9taires de recevoir les sommes pay\u00e9es par les Clients.&nbsp;<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA pourra proposer au Propri\u00e9taire d\u2019autres services sur le Site. Ces services pourront donner lieu \u00e0 des modalit\u00e9s de souscription diff\u00e9rentes et au paiement de commission compl\u00e9mentaire.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>6. SPECIFICATIONS TECHNIQUES<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Pour acc\u00e9der \u00e0 son Compte Propri\u00e9taire et pouvoir ainsi publier ses Annonces qualifi\u00e9es, le Propri\u00e9taire doit \u00eatre \u00e9quip\u00e9 de tous les outils n\u00e9cessaires, notamment les outils informatiques et logiciels de gestion ad\u00e9quats. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les acc\u00e8s au Compte Propri\u00e9taire sont plac\u00e9s sous la seule garde et la seule responsabilit\u00e9 du Propri\u00e9taire et se font au moyen d\u2019Identifiants. Par ailleurs, <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> se r\u00e9serve le droit, sans pr\u00e9avis ni indemnit\u00e9, d&rsquo;arr\u00eater temporairement ou d\u00e9finitivement un service ou l&rsquo;ensemble des services propos\u00e9s sur le Site. GRINTOURA agit comme interm\u00e9diaire et op\u00e9rateur de plateforme en ligne.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il est pr\u00e9cis\u00e9 au Propri\u00e9taire que GRINTOURA n\u2019exerce aucun contr\u00f4le sur la r\u00e9alisation des locations des Biens immobiliers et n\u2019intervient pas dans la transaction op\u00e9r\u00e9e entre le Client et le Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le contrat de location entre le Propri\u00e9taire et le Client est donc conclu exclusivement et directement entre le Client et le Propri\u00e9taire, GRINTOURA intervenant comme simple interm\u00e9diaire technique.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Annonces qualifi\u00e9es et l\u2019ensemble des indications sur les prix et les descriptions des Biens immobiliers sont \u00e9tablies exclusivement par les Propri\u00e9taires et restent sous leur enti\u00e8re responsabilit\u00e9<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En tant qu\u2019op\u00e9rateur de plateforme en ligne, GRINTOURA agit de mani\u00e8re neutre et transparente.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il est pr\u00e9cis\u00e9 que GRINTOURA n\u2019entretient aucun lien capitalistique ou de quelconque d\u00e9pendance juridique avec les Propri\u00e9taires r\u00e9f\u00e9renc\u00e9s sur le Site de nature \u00e0 influencer le classement ou le r\u00e9f\u00e9rencement des Annonces qualifi\u00e9es.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Annonces qualifi\u00e9es sur le Site sont pr\u00e9sent\u00e9es par le biais d\u2019un moteur de recherche th\u00e9matique fonctionnant gr\u00e2ce \u00e0 des mots clefs. <!-- A valider --><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Lors de la recherche dans le moteur de recherche, le classement des Annonces qualifi\u00e9es propos\u00e9es se fait de fa\u00e7on al\u00e9atoire \/ peut se faire selon divers param\u00e8tres tels que la pertinence ou le prix.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>8. CONDITIONS D\u2019ACCES ET D\u2019INSCRIPTION<\/b><\/span><\/span><\/p>\n<h2 class=\"western\" align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>8.1 R\u00e9f\u00e9rencement des Annonces qualifi\u00e9es<\/b><\/span><\/span><\/span><\/h2>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Chaque Propri\u00e9taire d\u00e9clare et s\u2019engage notamment :<\/span><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Etre en mesure de communiquer des informations exactes et compl\u00e8tes sur son identit\u00e9, son statut de professionnel et son activit\u00e9 commerciale,&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Respecter la l\u00e9gislation et la r\u00e9glementation tant fran\u00e7aises que communautaires ainsi qu\u2019un certain nombre d\u2019obligations contractuelles fix\u00e9es dans les pr\u00e9sentes Conditions G\u00e9n\u00e9rales d\u2019Utilisation qui s\u2019appliquent aux Annonces qualifi\u00e9es sur le Site ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Etre titulaire de tous les droits, \u00e9galement de propri\u00e9t\u00e9 intellectuelle, n\u00e9cessaires \u00e0 la location des Biens immobiliers ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Soumettre sur le Site des Annonces qualifi\u00e9es loyales, non trompeuses et non agressives ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Proposer un service de qualit\u00e9 aux Clients du Site (respect des d\u00e9lais de validation des commandes, efficacit\u00e9 et qualit\u00e9 du service clients,\u2026)&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">S\u2019interdire d\u2019utiliser une seule Annonce qualifi\u00e9e pour proposer plusieurs Biens immobiliers ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">S\u2019interdire de substituer au Bien immobilier propos\u00e9 dans une Annonce qualifi\u00e9e un Bien immobilier diff\u00e9rent&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">S\u2019interdire de proposer un Bien immobilier \u00e0 un Client sans aucun rapport \u00e0 celui pr\u00e9sent\u00e9 dans l\u2019Annonce qualifi\u00e9e indiqu\u00e9e sur le Site.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Une fois s\u00e9lectionn\u00e9s, les Propri\u00e9taires d\u00e9terminent librement le contenu des Annonces qualifi\u00e9es qu\u2019ils proposent sur le Site.&nbsp;<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA n&rsquo;effectue pas de contr\u00f4le a priori du contenu des Annonces qualifi\u00e9es publi\u00e9es par les Propri\u00e9taires sur le Site. Les Propri\u00e9taires sont seuls responsables des Contenus des Annonces qualifi\u00e9es qu\u2019ils publient.<\/span><\/span><\/span><\/span><\/p>\n<h2 class=\"western\" align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>8.2 D\u00e9r\u00e9f\u00e9rencement des Annonces qualifi\u00e9es<\/b><\/span><\/span><\/span><\/h2>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales d\u2019Utilisation sont applicables pour une dur\u00e9e ind\u00e9termin\u00e9e. En cons\u00e9quence, GRINTOURA<\/span><\/span><i> <\/i><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ou les Propri\u00e9taires peuvent les d\u00e9noncer \u00e0 tout moment sans avoir \u00e0 en justifier le motif moyennant le respect d\u2019un pr\u00e9avis d\u2019un (1) mois.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA se r\u00e9serve le droit de suspendre du Site de mani\u00e8re temporaire ou d\u00e9finitive tout ou partie des Annonces qualifi\u00e9es d\u2019un Propri\u00e9taire ne respectant pas ses obligations l\u00e9gales et\/ou contractuelles.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Cette suspension, totale ou partielle, s\u2019exercera sans indemnit\u00e9 pour le Propri\u00e9taire. <\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas de manquement grave ou r\u00e9p\u00e9t\u00e9 \u00e0 ses obligations l\u00e9gales et\/ou contractuelles, GRINTOURA ne sera pas tenu de respecter un d\u00e9lai de pr\u00e9avis.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas de suspension, de suppression ou de r\u00e9siliation du compte du Propri\u00e9taire, son profil sera archiv\u00e9 de mani\u00e8re s\u00e9curis\u00e9e et le Propri\u00e9taire y aura un acc\u00e8s limit\u00e9 pendant trois (3) ann\u00e9es \u00e0 compter de la date de la suspension, de suppression ou de r\u00e9siliation de son profil. Si la suspension venait \u00e0 \u00eatre lev\u00e9e, ou si le Propri\u00e9taire venait \u00e0 re-souscrire, GRINTOURA ne s\u2019engage pas \u00e0 ce que le nouveau Compte Propri\u00e9taire du Propri\u00e9taire contienne les donn\u00e9es qui \u00e9taient pr\u00e9sentes sur son Compte Propri\u00e9taire avant le terme ou la suspension de son compte.<\/span><\/span><\/span><\/span><\/p>\n<h2 class=\"western\" align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>8.3 Annonce qualifi\u00e9e<\/b><\/span><\/span><\/span><\/h2>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019Annonce qualifi\u00e9e contient notamment les \u00e9l\u00e9ments suivants :<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><a name=\"_Hlk95301948\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le nom du ou des Propri\u00e9taires proposant le Bien immobilier, avec un lien vers les mentions relatives \u00e0 l&rsquo;identit\u00e9 du Propri\u00e9taire et ses conditions de location ou d\u2019annulation&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La description du Bien immobilier et de ses caract\u00e9ristiques essentielles ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Des photographies du Bien immobilier&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le prix de la location du Bien immobilier fix\u00e9 par chaque Propri\u00e9taire&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La disponibilit\u00e9 du Bien immobilier aux dates choisies par le Client.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019Annonce qualifi\u00e9e sera affich\u00e9e pendant une dur\u00e9e ind\u00e9termin\u00e9e. Cependant, GRINTOURA se r\u00e9serve le droit de retirer ou de ne pas publier une quelconque Annonce qualifi\u00e9e \u00e0 tout moment sous r\u00e9serve de notification pr\u00e9alable. Le Propri\u00e9taire a la possibilit\u00e9 de retirer ou suspendre son Annonce qualifi\u00e9e \u00e0 tout moment, depuis son Compte Propri\u00e9taire ou en contactant GRINTOURA.<\/span><\/span><\/p>\n<h2 class=\"western\" align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>8.4 Classement des Annonces qualifi\u00e9es<\/b><\/span><\/span><\/span><\/h2>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Annonces qualifi\u00e9es pr\u00e9sent\u00e9es sur le Site s\u2019affichent par le biais d\u2019un moteur de recherche fonctionnant gr\u00e2ce \u00e0 des mots clefs. <\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Lors des recherches, le classement des Annonces qualifi\u00e9es propos\u00e9es peut se faire selon les principaux param\u00e8tres suivants :<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\">\n<\/p><p align=\"justify\"><font face=\"Arial Nova Light, serif\" size=\"2\">\u00e9quipements, dates, lieux, nombre de personnes<\/font><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le premier Bien immobilier aura donc le meilleur r\u00e9sultat global sur ces crit\u00e8res par rapport \u00e0 l\u2019ensemble des autres Biens immobiliers r\u00e9pondant \u00e0 la recherche.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>9. OBLIGATIONS DE GRINTOURA<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019obligation g\u00e9n\u00e9rale de GRINTOURA est une obligation de moyens. De plus, le Propri\u00e9taire s\u2019engage \u00e0 v\u00e9rifier que les informations ci-dessus sont actualis\u00e9es d\u00e8s que n\u00e9cessaire et demeurent en permanence \u00e0 jour pendant toute la dur\u00e9e d\u2019affichage de l\u2019Annonce qualifi\u00e9e sur le Site.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire doit s&rsquo;identifier aupr\u00e8s des Clients comme agissant ou non en qualit\u00e9 de professionnel. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s&rsquo;engage \u00e0 respecter la l\u00e9gislation applicable en mati\u00e8re d&rsquo;exercice d&rsquo;une activit\u00e9 commerciale (notamment immatriculation, obligations comptables, sociales et fiscales). En effet, le Propri\u00e9taire peut \u00eatre tenu de souscrire des d\u00e9clarations fiscales et sociales au titre de son activit\u00e9 de locations de biens sur le Site. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Par ailleurs, le Propri\u00e9taire s&rsquo;interdit express\u00e9ment de promouvoir directement ou indirectement, sous quelque forme que ce soit (notamment par l&rsquo;insertion de liens hypertextes, de tout message dans le descriptif des Biens immobiliers, ou encore par l&rsquo;utilisation de l&rsquo;adresse URL de son site Internet dans son identifiant) ses produits ou services, de m\u00eame que ceux de tout autre personne.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s&rsquo;engage \u00e0 mettre en \u0153uvre tous les moyens de fa\u00e7on \u00e0 satisfaire de mani\u00e8re optimale \u00e0 ses obligations en d\u00e9livrant un service de qualit\u00e9 vis-\u00e0-vis des Clients.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il s&rsquo;engage notamment pour cela \u00e0 r\u00e9pondre aux requ\u00eates des Clients dans un d\u00e9lai de <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">2 jours<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ouvr\u00e9s \u00e0 compter de leur r\u00e9ception, et ce, en langue fran\u00e7aise.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire doit r\u00e9pondre et accepter un grand nombre de demandes d\u2019information et demandes de r\u00e9servation. Le Propri\u00e9taire est dans l\u2019interdiction d\u2019annuler un grand nombre de r\u00e9servations pr\u00e9alablement accept\u00e9es.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout \u00e9change entre le Propri\u00e9taire et GRINTOURA est strictement confidentiel. Le Propri\u00e9taire s\u2019engage donc \u00e0 ne pas divulguer le contenu de ces \u00e9changes \u00e0 un tiers.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s\u2019interdit, et sans que cette liste soit limitative, d\u2019utiliser des visuels ou des noms commerciaux, des pseudonymes ou de tenir des propos ou autres messages qui seraient injurieux, contraires \u00e0 l\u2018ordre public ou aux bonnes m\u0153urs, qui porteraient atteinte aux droits de personnes ou aux droits de propri\u00e9t\u00e9 intellectuelle de tiers, aux lois et r\u00e8glements et \u00e0 l\u2019image de marque de GRINTOURA. A d\u00e9faut, GRINTOURA se r\u00e9serve le droit d&rsquo;interrompre de mani\u00e8re temporaire ou d\u00e9finitive l&rsquo;acc\u00e8s au Service au Propri\u00e9taire concern\u00e9, en suspendant ou en r\u00e9siliant les pr\u00e9sentes dans les conditions pr\u00e9vues \u00e0 l\u2019article 8.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s\u2019engage \u00e0 se conformer aux obligations l\u00e9gales d\u00e9finies aux articles L.111-1 et suivants du Code de la consommation fran\u00e7ais concernant les informations relatives au bien mis en location devant \u00eatre fournies au Client, dans la mesure o\u00f9 ces articles s\u2019appliquent au Propri\u00e9taire.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>10.2. Obligations relatives aux Annonces qualifi\u00e9es<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire d\u00e9clare et certifie \u00e0 titre permanent que tant qu\u2019un Bien immobilier est r\u00e9f\u00e9renc\u00e9 sur le Site, (i) il poss\u00e8de et \/ ou d\u00e9tient tous les droits et pouvoirs requis pour la proposer \u00e0 la location et accepter de prendre des r\u00e9servations le concernant, (ii) le cas \u00e9ch\u00e9ant il ne conservera pas ind\u00fbment un d\u00e9p\u00f4t de garantie en violation du contrat de location conclu avec le Client, (iii) que toutes les informations fournies \u00e0 GRINTOURA sont \u00e0 jour et exactes, y compris, \u00e0 titre non limitatif, toutes les d\u00e9clarations relatives aux Biens immobiliers, \u00e0 leurs \u00e9quipements, leur localisation, leur prix ou leur disponibilit\u00e9 \u00e0 une certaine date ou \u00e0 une certaine p\u00e9riode, (iv) il ne refusera pas ind\u00fbment \u00e0 des Clients l\u2019acc\u00e8s \u00e0 un Bien immobilier, (v) il effectuera tout remboursement exigible conform\u00e9ment \u00e0 la politique d\u2019annulation applicable ou au contrat de location en cause, sauf dans la mesure o\u00f9 cela concerne les Taxes de S\u00e9jour d\u00e9j\u00e0 collect\u00e9es par GRINTOURA.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire est seul responsable de la mise en location des Biens immobiliers qu&rsquo;il propose sur le Site.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire d\u00e9clare et certifie que la publication de son Annonce qualifi\u00e9e ne viole aucun contrat existant avec des tiers. En outre, le Propri\u00e9taire d\u00e9clare \u00eatre en conformit\u00e9 \u00e0 tous r\u00e8glements de zonage, r\u00e9gimes fiscaux, obligations d\u2019enregistrement, licences et autorisations applicables \u00e0 son Annonce qualifi\u00e9e.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s\u2019interdit notamment de proposer sur le Site sans que cette liste soit limitative : des produits \u00e0 caract\u00e8re pornographique et plus g\u00e9n\u00e9ralement portant atteinte aux bonnes m\u0153urs ; les biens incitant \u00e0 la haine raciale ou objets de discrimination bas\u00e9e sur la race, le sexe, la religion, nationalit\u00e9, les capacit\u00e9s physiques, l\u2019orientation sexuelle ou l\u2019\u00e2ge ; les objets vol\u00e9s ; les m\u00e9dicaments ou drogues de tous types ; les armes, armes de guerre et munitions ; les animaux vivants.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Sur le descriptif associ\u00e9 aux Biens immobiliers qu&rsquo;il propose sur le Site, le Propri\u00e9taire s&rsquo;engage \u00e0 agir de bonne foi. Il est seul responsable de l&rsquo;exactitude des mentions y figurant et s&rsquo;engage \u00e0 ce qu&rsquo;elles ne risquent pas d&rsquo;induire en erreur les Clients potentiels, tant sur les caract\u00e9ristiques du Bien immobilier que sur son \u00e9tat ou son prix. Le Propri\u00e9taire s\u2019engage \u00e0 v\u00e9rifier que les informations figurant dans son Annonce qualifi\u00e9e sont actualis\u00e9es d\u00e8s que n\u00e9cessaire et demeurent en permanence \u00e0 jour pendant toute la dur\u00e9e d\u2019affichage de l\u2019Annonce qualifi\u00e9e sur le Site, et si le Propri\u00e9taire fournit une traduction, il doit v\u00e9rifier que celle-ci est exacte et refl\u00e8te fid\u00e8lement le texte en langue originale.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire s&rsquo;engage en outre \u00e0 ce que les illustrations \/ visuels fournis dans le descriptif associ\u00e9 aux Biens immobiliers qu&rsquo;il propose (photographie) soient conformes aux Biens immobiliers ainsi illustr\u00e9s et respectent les droits des tiers et qu\u2019ils ne portent pas atteinte \u00e0 l\u2018ordre public ou aux bonnes m\u0153urs. Il garantit GRINTOURA qu&rsquo;il dispose des droits, en particulier de propri\u00e9t\u00e9 intellectuelle, aff\u00e9rents \u00e0 ces illustrations, qui lui permettent de les utiliser afin de pr\u00e9senter les Biens immobiliers.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Conform\u00e9ment aux dispositions de la loi pour la Confiance en l\u2019\u00c9conomie Num\u00e9rique, GRINTOURA pourra supprimer toute information du Site en cas de notification d\u2019un tiers faisant \u00e9tat du caract\u00e8re illicite de cette information ou d\u2019une violation d\u2019un droit.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire doit maintenir \u00e0 jour le calendrier de r\u00e9servations de son Bien immobilier. Le Propri\u00e9taire s\u2019engage \u00e0 v\u00e9rifier que le calendrier de r\u00e9servation de chaque Annonce qualifi\u00e9e est exact et actualis\u00e9 afin de refl\u00e9ter la disponibilit\u00e9 r\u00e9elle du Bien immobilier concern\u00e9.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Si une Annonce qualifi\u00e9e enfreint les pr\u00e9sentes CGU Propri\u00e9taires, GRINTOURA se r\u00e9serve le droit d&rsquo;exiger de la part du Propri\u00e9taire qu&rsquo;il corrige l&rsquo;infraction, qu&rsquo;il supprime le contenu en infraction, ou qu&rsquo;il suspende ou r\u00e9silie l\u2019Annonce qualifi\u00e9e en question, ou toutes les Annonces qualifi\u00e9es associ\u00e9es au Propri\u00e9taire, conform\u00e9ment \u00e0 l\u2019article 8 des pr\u00e9sentes CGU Propri\u00e9taires.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Aucune Annonce ne peut \u00eatre transf\u00e9r\u00e9e par le Propri\u00e9taire \u00e0 des tiers. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>10.3. Obligations relatives au prix de la location du Bien immobilier<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le prix de location du Bien immobilier est d\u00e9fini librement par le Propri\u00e9taire, dans le respect des lois et r\u00e8glements en vigueur.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Ce prix doit \u00eatre mentionn\u00e9 sur le Site&nbsp;toutes taxes comprises (notamment TVA).<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019ensemble des taxes et frais devront faire l\u2019objet d\u2019une mention clairement indiqu\u00e9e lors de la validation de la Commande ainsi que sur les factures adress\u00e9es au Client.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Propri\u00e9taires sont seuls responsables de contracter une police d\u2019assurance suffisante pour prot\u00e9ger leurs Biens immobiliers. Les Propri\u00e9taires attestent avoir contract\u00e9, ou conviennent de contracter avant l\u2019arriv\u00e9e de leur premier Client, une police d\u2019assurance ad\u00e9quate et suffisante pour couvrir les Biens immobiliers qu\u2019ils proposent sur le Site, et ils conserveront une telle assurance ad\u00e9quate jusqu\u2019\u00e0 la date de d\u00e9part de tout Client ayant lou\u00e9 leur Bien immobilier par le biais du Site.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>10.4. Obligations relatives \u00e0 la location des Biens immobiliers<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Biens immobiliers propos\u00e9s par le Propri\u00e9taire sur le Site font l\u2019objet de contrats conclus entre le Propri\u00e9taire et le Client. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire est inform\u00e9 par <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">courriel <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">et sur son Compte Propri\u00e9taire lorsqu&rsquo;un Bien immobilier qu&rsquo;il a mis en ligne a fait l&rsquo;objet d&rsquo;une Commande par un Client.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire doit alors confirmer la Commande concern\u00e9e dans un d\u00e9lai de <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">2 jours<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ouvr\u00e9s suivant la r\u00e9ception de l&rsquo;information de la Commande.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Aussi, le Propri\u00e9taire s&rsquo;engage \u00e0 consulter r\u00e9guli\u00e8rement, et au moins une fois par jour ouvr\u00e9, ses emails re\u00e7us \u00e0 l&rsquo;adresse fournie \u00e0 GRINTOURA lors de l&rsquo;ouverture de son compte afin de pouvoir confirmer les Biens immobiliers lou\u00e9s par les Clients.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La confirmation de la Commande par le Propri\u00e9taire implique pour le Propri\u00e9taire, l&rsquo;engagement ferme de louer le Bien immobilier au Client aux dates indiqu\u00e9es lors de la Commande.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">A d\u00e9faut de r\u00e9ponse du Propri\u00e9taire dans le d\u00e9lai de <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">2 jours<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ouvr\u00e9s indiqu\u00e9 ci-dessus, le contrat de location sera automatiquement annul\u00e9.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas d&rsquo;absence ou d&rsquo;indisponibilit\u00e9 de plus de <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">2 jours<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ouvr\u00e9s, le Propri\u00e9taire doit suspendre temporairement la mise en ligne de ses Annonces qualifi\u00e9es.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>10.5. Obligations relatives aux contestations relatives aux locations des Biens immobiliers<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">De mani\u00e8re g\u00e9n\u00e9rale, le Propri\u00e9taire s&rsquo;engage \u00e0 mettre en \u0153uvre, de bonne foi, tous les moyens n\u00e9cessaires afin de remplir ses obligations en d\u00e9livrant un service de qualit\u00e9 aux Clients.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client a la possibilit\u00e9 de contacter le Propri\u00e9taire \u00e0 tout moment, d\u2019adresser toute demande, r\u00e9clamation relative aux Biens immobiliers lou\u00e9s <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">en utilisant l\u2019outil de messagerie mis \u00e0 disposition dans le cadre du Service<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas de r\u00e9clamation d&rsquo;un Client concernant un Bien immobilier, le Propri\u00e9taire fait son affaire personnelle de la r\u00e9solution du diff\u00e9rend qui l&rsquo;oppose au Client. Les litiges sont directement r\u00e9gl\u00e9s entre le Client et le Propri\u00e9taire. Le Propri\u00e9taire devra faire ses meilleurs efforts pour r\u00e9soudre le litige l&rsquo;opposant au Client amiablement.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>10.6. R\u00e9tractation<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le droit de r\u00e9tractation est exclu en application de l\u2019article L.221-28, 12\u00b0 du Code de la consommation.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>10.7. Non-respect des obligations par le Propri\u00e9taire<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il est rappel\u00e9 que GRINTOURA se r\u00e9serve le droit de suspendre d\u00e9finitivement ou temporairement l\u2019acc\u00e8s au service au Propri\u00e9taire concern\u00e9 en cas de non-respect de ses obligations, tel que pr\u00e9vu dans l\u2019article 8.<\/span><\/span><\/p>\n<p align=\"justify\">\n<\/p><p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>11. RESPONSABILITE<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA&nbsp;ne peut en aucun cas \u00eatre tenu responsable dans les cas suivants&nbsp;: <\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">acc\u00e8s temporairement impossible au Site pour des op\u00e9rations de maintenance technique ou d\u2019actualisation des informations publi\u00e9es. Le Propri\u00e9taire reconnait que la responsabilit\u00e9 de GRINTOURA ne saurait \u00eatre engag\u00e9 en cas de dysfonctionnements ou d\u2019interruptions desdits r\u00e9seaux de transmission ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">utilisation anormale ou exploitation illicite du Site par un Utilisateur ou un tiers ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">affichages de contenus de sites internet tiers vers lesquels renvoient des liens hypertextes pr\u00e9sents sur le Site ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">non-respect des pr\u00e9sentes CGU imputable aux Utilisateurs ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">retard ou inex\u00e9cution de ses obligations, lorsque la cause du retard ou de l\u2019inex\u00e9cution est li\u00e9e \u00e0 un cas de force majeure telle qu\u2019elle est d\u00e9finie \u00e0 l\u2019article 13 des pr\u00e9sentes CGU ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">attaques virales, intrusion illicite dans un syst\u00e8me de traitement automatis\u00e9 de donn\u00e9es ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">cause \u00e9trang\u00e8re non imputable \u00e0 GRINTOURA&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas d\u2019agissement illicite d\u2019un Propri\u00e9taire, ou d\u2019inex\u00e9cution contractuelle dont un Propri\u00e9taire se serait rendu auteur dans le cadre de la location d\u2019un Bien immobilier ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">De tout probl\u00e8me rencontr\u00e9 lors de l\u2019ex\u00e9cution de la Commande par le Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas d\u2019utilisation anormale ou d\u2019une exploitation illicite du Site, l\u2019Utilisateur en cause est alors seul responsable des dommages caus\u00e9s aux tiers et des cons\u00e9quences des r\u00e9clamations ou actions qui pourraient en d\u00e9couler.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>12. STATUT D\u2019HEBERGEUR DE GRINTOURA<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout Propri\u00e9taire reconnait que GRINTOURA a la qualit\u00e9 d\u2019h\u00e9bergeur au sens de l\u2019article 6 I 2\u00b0 de la loi du 21 juin 2004 pour la confiance dans l\u2019\u00e9conomie num\u00e9rique.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La notification des contenus manifestement illicites par un Utilisateur ou tout autre tiers doit se faire par courriel \u00e0 l\u2019adresse : reclamations@grintoura.fr ou par courrier en recommand\u00e9 avec avis de r\u00e9ception \u00e0 : Grintoura 13 rue des faisans 67370 Truchtersheim &nbsp;en indiquant les \u00e9l\u00e9ments list\u00e9s sou l\u2019article 6 I 5\u00b0 de la loi du 21 juin 2004.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>13. FORCE MAJEURE<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La responsabilit\u00e9 du Propri\u00e9taire ou de GRINTOURA ne pourra pas \u00eatre mise en \u0153uvre si la non-ex\u00e9cution ou le retard dans l\u2019ex\u00e9cution de l\u2019une de leurs obligations d\u00e9crites dans les pr\u00e9sentes CGU d\u00e9coule d\u2019un cas de force majeure au sens que lui donne la jurisprudence.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Si l\u2019emp\u00eachement est temporaire, l\u2019ex\u00e9cution de l\u2019obligation est suspendue \u00e0 moins que le retard qui en r\u00e9sulterait ne justifie la r\u00e9solution du contrat. Si l\u2019emp\u00eachement est d\u00e9finitif, le contrat est r\u00e9solu de plein droit et GRINTOURA ou le Propri\u00e9taire sera&nbsp;lib\u00e9r\u00e9 de ses obligations dans les conditions pr\u00e9vues aux articles 1351 et 1351-1 du Code civil.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas de survenance d\u2019un des \u00e9v\u00e9nements susvis\u00e9s, GRINTOURA s\u2019efforcera d\u2019informer le Propri\u00e9taire dans les meilleurs d\u00e9lais.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>14. <\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>DROITS DE PROPRIETE INTELLECTUELLE <\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>14.<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>1 Propri\u00e9t\u00e9 intellectuelle du Propri\u00e9taire<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans le cadre de la location des Biens immobiliers via le Site, les Propri\u00e9taires sont susceptibles de pr\u00e9senter au sein de leurs Annonces qualifi\u00e9es des photographies, marques, logos, dessins et autres mod\u00e8les (des Contenus) leur appartenant ou appartenant \u00e0 des tiers.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout Propri\u00e9taire proposant des Biens immobiliers \u00e0 la location par l\u2019interm\u00e9diaire du Site garantit qu\u2019il a le droit de publier et de repr\u00e9senter tous les Contenus, li\u00e9s notamment \u00e0 ses Annonces qualifi\u00e9es.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En tout \u00e9tat de cause, GRINTOURA ne saurait en aucun cas \u00eatre tenu responsable d\u2019un acte de contrefa\u00e7on ou de concurrence d\u00e9loyale, compte tenu de sa simple qualit\u00e9 d\u2019h\u00e9bergeur des Contenus publi\u00e9s par les Propri\u00e9taires.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>14.2. Propri\u00e9t\u00e9 intellectuelle de GRINTOURA<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les marques, logos, slogans, graphismes, photographies, animations, vid\u00e9os, solutions logicielles et textes et tout autre contenu sur le Site,&nbsp;\u00e0 l\u2019exception des Contenus publi\u00e9s par les Propri\u00e9taires, sont la propri\u00e9t\u00e9 intellectuelle exclusive de GRINTOURA et ne peuvent \u00eatre reproduits, utilis\u00e9s ou repr\u00e9sent\u00e9s sans autorisation expresse de GRINTOURA.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Toute repr\u00e9sentation ou reproduction, totale ou partielle, du Site et de son contenu, par quel que proc\u00e9d\u00e9 que ce soit, sans l\u2019autorisation pr\u00e9alable expresse de GRINTOURA est interdite et constituera une contrefa\u00e7on sanctionn\u00e9e par les dispositions du Code de la Propri\u00e9t\u00e9 Intellectuelle.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire reconnait les droits de propri\u00e9t\u00e9 intellectuelle de GRINTOURA et s\u2019engage \u00e0 les respecter.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Par les pr\u00e9sentes CGU, GRINTOURA accorde une licence personnelle, non-exclusive et non cessible aux Propri\u00e9taires les autorisant \u00e0 utiliser le Site en tant que Propri\u00e9taire, dans des conditions normales d\u2019utilisation et conform\u00e9ment aux pr\u00e9sentes CGU.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Toute autre utilisation du Site et de son contenu est exclue du domaine de la pr\u00e9sente licence et ne pourra \u00eatre effectu\u00e9e sans l\u2019autorisation pr\u00e9alable expresse de GRINTOURA.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>15<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b> PROTECTION DES DONNEES A CARACTERE PERSONNEL ET COOKIES<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>15.1. Traitements r\u00e9alis\u00e9s par GRINTOURA<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Conform\u00e9ment \u00e0 la r\u00e9glementation relative \u00e0 la protection des donn\u00e9es \u00e0 caract\u00e8re personnel, le Client est inform\u00e9 que GRINTOURA en tant que responsable du traitement, met en \u0153uvre un traitement de donn\u00e9es \u00e0 caract\u00e8re personnel.<\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97581648\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les donn\u00e9es \u00e0 caract\u00e8re personnel sont enregistr\u00e9es dans son fichier Clients et sont indispensables au traitement de sa commande (Int\u00e9r\u00eat l\u00e9gitime). Ces informations et donn\u00e9es personnelles sont \u00e9galement conserv\u00e9es \u00e0 des fins de s\u00e9curit\u00e9, afin de respecter les obligations l\u00e9gales et r\u00e9glementaires. Elles seront conserv\u00e9es pendant trois ans. Les factures li\u00e9es aux locations de Biens immobiliers sont conserv\u00e9es 10 ans.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le responsable du traitement des donn\u00e9es est GRINTOURA. L&rsquo;acc\u00e8s aux donn\u00e9es personnelles sera strictement limit\u00e9 aux employ\u00e9s du responsable de traitement, habilit\u00e9s \u00e0 les traiter en raison de leurs fonctions. Les informations recueillies pourront \u00e9ventuellement \u00eatre communiqu\u00e9es \u00e0 des tiers li\u00e9s \u00e0 l&rsquo;entreprise par contrat pour l&rsquo;ex\u00e9cution de t\u00e2ches sous-trait\u00e9es, sans que l&rsquo;autorisation du Client soit n\u00e9cessaire.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA fait appel \u00e0 des sous-traitants pour les op\u00e9rations suivantes :<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">le paiement s\u00e9curis\u00e9 sur le Site&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">la lutte contre la fraude et le recouvrement des impay\u00e9s<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">la r\u00e9alisation d\u2019op\u00e9rations de maintenance et de d\u00e9veloppement techniques du Site.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans le cadre de l&rsquo;ex\u00e9cution de leurs prestations, les tiers n&rsquo;ont qu&rsquo;un acc\u00e8s limit\u00e9 aux donn\u00e9es et ont l&rsquo;obligation de les utiliser en conformit\u00e9 avec les dispositions de la l\u00e9gislation applicable en mati\u00e8re de protection des donn\u00e9es personnelles.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les informations recueillies pourront \u00e9galement \u00eatre communiqu\u00e9es \u00e0 des tiers<\/span><\/span> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">qui peuvent traiter les donn\u00e9es pour leur compte&nbsp;:<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">les Propri\u00e9taires du Site&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">les Vendeurs ou les Prestataires du site internet grinmarket&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">les autorit\u00e9s de police dans le cadre des r\u00e9quisitions judiciaires concernant la lutte contre la fraude.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En dehors des cas \u00e9nonc\u00e9s ci-dessus, GRINTOURA s&rsquo;interdit de vendre, louer, c\u00e9der ou donner acc\u00e8s \u00e0 des tiers aux donn\u00e9es sans consentement pr\u00e9alable du Client, \u00e0 moins d&rsquo;y \u00eatre contrainte en raison d&rsquo;un motif l\u00e9gitime.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Si les donn\u00e9es sont amen\u00e9es \u00e0 \u00eatre transf\u00e9r\u00e9es en dehors de l&rsquo;UE, le Client en sera inform\u00e9 et les garanties prises afin de s\u00e9curiser les donn\u00e9es lui seront pr\u00e9cis\u00e9es.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Conform\u00e9ment \u00e0 la r\u00e9glementation applicable, le Client dispose d&rsquo;un droit d&rsquo;acc\u00e8s, de rectification, d&rsquo;effacement, et de portabilit\u00e9 des donn\u00e9es le concernant, ainsi que du droit de s&rsquo;opposer au traitement pour motif l\u00e9gitime, droits qu&rsquo;il peut exercer en s&rsquo;adressant au responsable de traitement \u00e0 l&rsquo;adresse postale ou email suivante : reclamations@grintoura.fr<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas de r\u00e9clamation, le Client peut adresser une r\u00e9clamation aupr\u00e8s du d\u00e9l\u00e9gu\u00e9 \u00e0 la protection des donn\u00e9es personnelles de GRINTOURA et de la Commission Nationale de l&rsquo;Informatique et des Libert\u00e9s.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>15.2. Traitements r\u00e9alis\u00e9s par le Propri\u00e9taire<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire peut \u00eatre amen\u00e9 \u00e0 collecter et traiter les donn\u00e9es \u00e0 caract\u00e8re personnel des Clients ayant pass\u00e9 Commande aupr\u00e8s de lui \u00e0 partir du Site pour les seuls besoins de l\u2019ex\u00e9cution de la Commande concern\u00e9e. Il pourra \u00e9galement conserver les donn\u00e9es des Clients afin de r\u00e9pondre \u00e0 ses obligations l\u00e9gales, notamment fiscales et comptables, ou pour g\u00e9rer les \u00e9ventuels litiges avec ces Clients. VALIDITE DES CGU<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les pr\u00e9sentes CGU sont applicables au Propri\u00e9taire d\u00e8s l\u2019utilisation des Services et la demande de souscription au Compte Propri\u00e9taire en qualit\u00e9 de Propri\u00e9taire.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Si l\u2019une quelconque des stipulations des pr\u00e9sentes CGU venait \u00e0 \u00eatre d\u00e9clar\u00e9e nulle au regard d\u2019une disposition l\u00e9gislative ou r\u00e9glementaire en vigueur et\/ou d\u2019une d\u00e9cision de justice ayant autorit\u00e9 de la chose jug\u00e9e, elle sera r\u00e9put\u00e9e non \u00e9crite mais n\u2019affectera en rien la validit\u00e9 des autres clauses qui demeureront pleinement applicables.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Une telle modification ou d\u00e9cision n\u2019autorise en aucun cas le Propri\u00e9taire \u00e0 m\u00e9connaitre les pr\u00e9sentes Conditions G\u00e9n\u00e9rales d\u2019Utilisation.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>18. DISPOSITIONS GENERALES<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le fait que ni le Propri\u00e9taire, ni GRINTOURA n&rsquo;ait exig\u00e9 l&rsquo;application d&rsquo;une clause quelconque des pr\u00e9sentes CGU, que ce soit de fa\u00e7on permanente ou temporaire, ne pourra en aucun cas \u00eatre consid\u00e9r\u00e9 comme une renonciation \u00e0 ladite clause.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas de difficult\u00e9 d\u2019interpr\u00e9tation entre l\u2019un quelconque des titres figurant en t\u00eate des clauses, et l\u2019une quelconque de celles-ci, les titres seront d\u00e9clar\u00e9s inexistants.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>19. COMPETENCE ET DROIT APPLICABLE<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">LES PRESENTES CGU AINSI QUE LES RELATIONS ENTRE LE PROPRIETAIRE ET GRINTOURA SONT REGIES PAR LE DROIT FRAN\u00c7AIS.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas de diff\u00e9rend survenant entre&nbsp;GRINTOURA et un Propri\u00e9taire, au sujet de l\u2019interpr\u00e9tation, de l\u2019ex\u00e9cution ou de la r\u00e9siliation des pr\u00e9sentes, le Propri\u00e9taire est inform\u00e9 qu\u2019il peut utiliser le syst\u00e8me de traitement interne des r\u00e9clamations mis en place par GRINTOURA.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Pour en b\u00e9n\u00e9ficier, le Propri\u00e9taire peut saisir GRINTOURA aux adresses indiqu\u00e9es \u00e0 l\u2019article 16 des CGU. Ce syst\u00e8me est facilement accessible et gratuit et garantit un traitement dans un d\u00e9lai raisonnable. GRINTOURA prendra en consid\u00e9ration les r\u00e9clamations d\u00e9pos\u00e9es et assurera le suivi \u00e9ventuellement n\u00e9cessaire afin de r\u00e9soudre le probl\u00e8me soulev\u00e9 de mani\u00e8re appropri\u00e9e. Les r\u00e9clamations seront trait\u00e9es rapidement et efficacement, en tenant compte de l\u2019importance et de la complexit\u00e9 du probl\u00e8me soulev\u00e9. GRINTOURA communiquera au Propri\u00e9taire le r\u00e9sultat du processus de traitement interne de sa r\u00e9clamation.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA et le Propri\u00e9taire s\u2019efforceront de trouver un accord amiable dans un d\u00e9lai raisonnable (qui ne pourra pas exc\u00e9der 30 jours) \u00e0 compter de la notification d\u2019une r\u00e9clamation, qu\u2019elle soit formul\u00e9e par le Propri\u00e9taire au titre du syst\u00e8me interne de plaintes d\u00e9crit ci-dessus ou bien par GRINTOURA au moyen d\u2019un courriel.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il est convenu que GRINTOURA et le Propri\u00e9taire conservent en toutes circonstances la facult\u00e9 d\u2019agir par devant la juridiction des r\u00e9f\u00e9r\u00e9s sur le fondement notamment des articles 145, 872 et 873 du Code de Proc\u00e9dure Civile.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Si le Propri\u00e9taire est un consommateur, conform\u00e9ment aux dispositions du Code de la consommation concernant le r\u00e8glement amiable des litiges, GRINTOURA adh\u00e8re au Service du M\u00e9diateur du e-commerce de la FEVAD (F\u00e9d\u00e9ration du e-commerce et de la vente \u00e0 distance) dont les coordonn\u00e9es sont les suivantes : 60 rue de la Bo\u00e9tie \u2013 75008 Paris \u2013 http:\/\/www.mediateurfevad.fr\/.
