Toute modification prendra effet dans le d\u00e9lai de 72 heures \u00e0 compter de la modification. OBJET<\/span><\/span><\/h3>\n<p align=\"justify\"><a name=\"_Hlk97626683\"><\/a> <span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les pr\u00e9sentes CGU Client ont pour objet de d\u00e9finir les conditions dans lesquelles GRINTOURA met \u00e0 la disposition des Clients, sur le Site, les outils technologiques leur permettant de louer des biens immobiliers propos\u00e9s par les Propri\u00e9taires. <\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA publie \u00e9galement des annonces de vente ou de service de vendeurs ou prestataires locaux afin de proposer aux Clients des produits ou des exp\u00e9riences autour du bien immobilier lou\u00e9.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans ce cadre, il est rappel\u00e9 que GRINTOURA intervient en tant qu\u2019op\u00e9rateur de plateforme num\u00e9rique, comme simple interm\u00e9diaire. Son r\u00f4le est limit\u00e9 \u00e0 l\u2019h\u00e9bergement des Annonces et des Annonces qualifi\u00e9es sur le Site et \u00e0 la mise en relation des Clients avec les Propri\u00e9taires.&nbsp;<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97626721\"><\/a> <span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA n\u2019est pas un organisateur ou un d\u00e9taillant de voyages \u00e0 forfait au sens de la directive (UE) 2015\/2302 relative aux voyages \u00e0 forfait. Par ailleurs, GRINTOURA n\u2019agit pas en qualit\u00e9 de commer\u00e7ant aux fins de prestations de voyages li\u00e9es au sens de la directive (UE) 2015\/2302.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client est inform\u00e9 qu\u2019avec le Propri\u00e9taire, ils sont responsables de remplir leurs obligations en vertu du contrat qu\u2019ils ont conclu, et que GRINTOURA n\u2019est aucunement partie \u00e0 de tels contrats conclus entre le Client et le Propri\u00e9taire, n\u2019agit pas en tant qu\u2019agent des Propri\u00e9taires, et rejette toute responsabilit\u00e9 r\u00e9sultant de ces contrats m\u00eame si le Site facilite la r\u00e9servation d\u2019une location de biens immobiliers \u00e9tant donn\u00e9 que GRINTOURA n\u2019est partie \u00e0 aucun contrat de location ou autre entre un Client et un Propri\u00e9taire.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Propri\u00e9taires peuvent \u00eatre soit des particuliers, agissant de consommateur \u00e0 consommateur, soit des professionnels agissant de professionnel \u00e0 consommateur. Le Client qui conclut un contrat avec un Propri\u00e9taire particulier est inform\u00e9 que le droit de la consommation ne s\u2019appliquera pas au contrat conclu avec ledit Propri\u00e9taire particulier. Le Propri\u00e9taire est seul responsable de d\u00e9terminer s\u2019il exerce ou non une activit\u00e9 professionnelle, ainsi que de toute \u00e9ventuelle d\u00e9claration qu\u2019il pourrait faire aux Clients en ce qui concerne son statut.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>2. DEFINITIONS<\/b><\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les termes indiqu\u00e9s par une Majuscule, ont la signification suivante dans les pr\u00e9sentes Conditions G\u00e9n\u00e9rales :<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Annonce<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> \u00bb&nbsp;: d\u00e9signe une pr\u00e9sentation de produits ou de services sans possibilit\u00e9 d\u2019achat sur le Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97627002\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Annonce<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>qualifi\u00e9e<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> \u00bb&nbsp;: d\u00e9signe l\u2019offre de location de biens immobiliers propos\u00e9e par le Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97627368\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Bien immobilier<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;\u00bb&nbsp;: d\u00e9signe tout bien immobilier propos\u00e9e \u00e0 la location par le Propri\u00e9taire aux Clients via le Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97627056\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Client&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe toute personne physique ou morale, acc\u00e9dant au Site et proc\u00e9dant \u00e0 la location d\u2019un bien immobilier propos\u00e9 par un Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97627072\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Commande&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe la location d\u2019un ou de plusieurs biens immobiliers r\u00e9alis\u00e9e par un Client sur le Site.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Compte Client<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">&nbsp;\u00bb : d\u00e9signe l\u2019interface permettant au Client d\u2019acc\u00e9der \u00e0 son espace priv\u00e9 en ligne, de le configurer et de suivre les Commandes effectu\u00e9es aupr\u00e8s des Propri\u00e9taires. Le Site est un espace sur lequel des Propri\u00e9taires proposent \u00e0 la location des Biens immobiliers, par l\u2019interm\u00e9diaire de GRINTOURA, agissant en tant qu\u2019op\u00e9rateur de plateforme en ligne (interm\u00e9diaire).&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00ab&nbsp;<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>Utilisateur&nbsp;<\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00bb : d\u00e9signe de fa\u00e7on g\u00e9n\u00e9rique toute personne qui acc\u00e8de et navigue sur le Site, qu\u2019il soit Propri\u00e9taire, Client, ou simple internaute.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3. CONDITIONS D\u2019ACCES AU SITE ET NATURE DES SERVICES <\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>PROPOSES AUX CLIENTS<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout Utilisateur peut acc\u00e9der au Site et b\u00e9n\u00e9ficier des Services d\u00e9crits ci-apr\u00e8s.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Chaque Utilisateur a la possibilit\u00e9 de consulter gratuitement les Annonces ainsi que les Annonces qualifi\u00e9es pr\u00e9sentant les Biens immobiliers r\u00e9f\u00e9renc\u00e9s sur le Site en vue de les louer et ainsi de devenir Client.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3.1. Condition d\u2019acc\u00e8s au Site<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3.1.1 Cr\u00e9ation du Compte Client<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout Utilisateur souhaitant avoir un acc\u00e8s \u00e0 l\u2019ensemble des fonctionnalit\u00e9s propos\u00e9es par le Site devra pr\u00e9alablement se cr\u00e9er, sur le Site, un Compte Client pour devenir Client. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La cr\u00e9ation du Compte Client permettra au Client de louer les Biens immobiliers pr\u00e9sent\u00e9s sur le Site.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019inscription sur le Site en tant que Client est gratuite.<\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk95218263\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Pour cr\u00e9er un Compte Client, l\u2019Utilisateur est invit\u00e9 \u00e0 fournir certaines informations telles que :<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Nom&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif; font-size: small;\">Nom d&rsquo;utilisateur<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif; font-size: small;\">Mot de passe<\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><a name=\"_Hlk95218338\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019Utilisateur souhaitant devenir Client s\u2019engage \u00e0 fournir des donn\u00e9es exactes, loyales et \u00e0 jour, qui ne portent pas atteinte, \u00e0 quelque titre que ce soit, aux droits des tiers.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client s\u2019engage \u00e0 ne cr\u00e9er qu\u2019un seul et unique Compte Client. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> d\u00e9cline toute responsabilit\u00e9 quant aux cons\u00e9quences dommageables que pourrait avoir l\u2019utilisation de Comptes Clients multiples pour un seul Client.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client est enti\u00e8rement responsable de l\u2019exactitude et de la mise \u00e0 jour des donn\u00e9es communiqu\u00e9es dans le cadre de l\u2019ouverture et de la gestion de son Compte Client.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client sera seul responsable de l&rsquo;utilisation de ses Identifiants ou des actions faites par l&rsquo;interm\u00e9diaire de son Compte Client.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans le cas o\u00f9 un Client divulguerait ou utiliserait ses Identifiants de fa\u00e7on contraire \u00e0 leur destination, <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> pourra alors suspendre l\u2019utilisation du Compte Client.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En aucun cas, <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ne saurait \u00eatre tenu responsable en cas d\u2019usurpation de l\u2019identit\u00e9 d\u2019un Client. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout acc\u00e8s et action effectu\u00e9 \u00e0 partir du Compte Client d\u2019un Client sera pr\u00e9sum\u00e9 \u00eatre effectu\u00e9 par ce Client, dans la mesure o\u00f9 <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> n\u2019a pas pour obligation et ne dispose pas des moyens techniques lui permettant de s\u2019assurer de l\u2019identit\u00e9 des personnes ayant acc\u00e8s au Site \u00e0 partir d\u2019un Compte Client.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Toute perte, d\u00e9tournement, ou utilisation non autoris\u00e9e des Identifiants d\u2019un Client et leurs cons\u00e9quences rel\u00e8vent de la seule responsabilit\u00e9 du Client, ce dernier \u00e9tant tenu d\u2019en avertir le Site, sans d\u00e9lai, par courriel adress\u00e9 \u00e0 l\u2019adresse suivante&nbsp;: reclamations@grintoura.fr<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3.1.2. Fermeture du Compte Client<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client peut \u00e0 tout moment fermer son Compte Client en adressant un courriel \u00e0 l\u2019adresse suivante&nbsp;: reclamations@grintoura.fr<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Site proc\u00e9dera sous <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">5 jours<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> \u00e0 une d\u00e9sactivation du Compte Client et adressera au Client un courriel lui confirmant la cl\u00f4ture de son Compte et la suppression d\u00e9finitive de l\u2019ensemble de ses donn\u00e9es sur le Site, exception faite des \u00e9l\u00e9ments dont la conservation est requise par la loi.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3.2. Services offerts aux Utilisateurs&nbsp;<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le principal Service propos\u00e9 par <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> consiste \u00e0 offrir \u00e0 tout Utilisateur la possibilit\u00e9 de consulter les Annonces ainsi que les Annonces qualifi\u00e9es pr\u00e9sentant les Biens immobiliers r\u00e9f\u00e9renc\u00e9s sur le Site et lui permettre d\u2019entrer en relation avec les Propri\u00e9taires afin de louer le Bien immobilier apr\u00e8s avoir cr\u00e9\u00e9 un Compte Client.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Annonces pourront contenir des liens hypertextes renvoyant sur un site internet marchand.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En se cr\u00e9ant un Compte Client, tout Client pourra acc\u00e9der aux fonctionnalit\u00e9s suivantes : &nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3.2.1. Location de Biens immobiliers<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout Client aura la possibilit\u00e9 de louer un Bien immobilier propos\u00e9 par les Propri\u00e9taires via le Site. &nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Chaque Bien immobilier mis en location par le biais du Site est d\u00e9crit dans une Annonce qualifi\u00e9e qui lui sera consacr\u00e9e.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019Annonce qualifi\u00e9e contient notamment&nbsp;:<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le nom du ou des Propri\u00e9taires proposant le Bien immobilier, avec un lien vers les mentions relatives \u00e0 l&rsquo;identit\u00e9 du Propri\u00e9taire et ses conditions de location ou d\u2019annulation&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La description du Bien immobilier et de ses caract\u00e9ristiques essentielles ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Des photographies du Bien immobilier&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le prix de la location du Bien immobilier fix\u00e9 par chaque Propri\u00e9taire&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La disponibilit\u00e9 du Bien immobilier aux dates choisies par le Client.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019ensemble des Annonces qualifi\u00e9es des Propri\u00e9taires sont cr\u00e9\u00e9es et renseign\u00e9es par les Propri\u00e9taires qui sont seuls responsables du descriptif fourni, des images du Bien immobilier et de la d\u00e9termination du prix de la location. <\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97579441\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Des frais de service sont factur\u00e9s par GRINTOURA au Client (ci-apr\u00e8s les \u00ab Frais de Service \u00bb) lors de la Commande d\u2019un Bien immobilier. Ces Frais de service correspondent au taux de 8 % du montant total de la location (ce montant total peut inclure des frais additionnels, des taxes, et un d\u00e9p\u00f4t de garantie, factur\u00e9s par le Propri\u00e9taire). Le Client reconna\u00eet et accepte express\u00e9ment que le droit de r\u00e9tractation est exclu en application de l\u2019article L.221-28, 12\u00b0 du Code de la consommation. Les Frais de Service, plus les \u00e9ventuelles taxes applicables \u00e0 ceux-ci, seront indiqu\u00e9s au Client au moment de la Commande et avant le paiement final. Le cas \u00e9ch\u00e9ant, une TVA, une taxe de s\u00e9jour ou toutes autres taxes indirectes \u00e9quivalentes applicables pourraient \u00eatre ajout\u00e9es aux Frais de Service (ou incluses \u00e0 ces derniers). Les Frais de Service pourront faire l\u2019objet d\u2019un remboursement uniquement dans le cas o\u00f9 le Propri\u00e9taire accepte l\u2019annulation de la location du Client et rembourse le montant total de la location. Le Propri\u00e9taire s\u2019engage \u00e0 ne pas encourager ni conseiller le Client \u00e0 contourner ou \u00e9viter le paiement des Frais de Service factur\u00e9s par GRINTOURA, et le Client s\u2019engage \u00e0 ne pas contourner ou \u00e9viter le paiement des Frais de Service.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA pourrait \u00eatre dans l\u2019obligation de collecter et de reverser des taxes (y compris la TVA, des taxes \u00e0 la consommation et d\u2019autres taxes \u00e9quivalentes) sur les Frais de Service. Le cas \u00e9ch\u00e9ant, GRINTOURA enverra au Client une facture indiquant le montant des taxes factur\u00e9es sur ces Frais de Service. Si le Client est en droit de b\u00e9n\u00e9ficier d\u2019une exon\u00e9ration de toutes taxes indirectes, ou de leur \u00e9quivalent, sur les Frais de service, il doit fournir \u00e0 GRINTOURA les justificatifs d\u2019une telle exon\u00e9ration.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Clients sont responsables du paiement de la Taxe de s\u00e9jour. Seules les personnes \u00e2g\u00e9es de 18 ans et plus sont redevables du paiement de la Taxe de s\u00e9jour. En cas d\u2019exceptions au paiement de la taxe de s\u00e9jour, le Client pourrait demander un remboursement aupr\u00e8s de l\u2019autorit\u00e9 locale en charge de collecter la taxe de s\u00e9jour. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Conform\u00e9ment \u00e0 l\u2019article L2333-33 du Code g\u00e9n\u00e9ral des collectivit\u00e9s territoriales, GRINTOURA collectera la Taxe de s\u00e9jour.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><i><u>GRINTOURA<\/u><\/i><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><u> recommande aux Clients de bien prendre connaissance des conditions de location du Bien immobilier et de la politique d\u2019annulation du Propri\u00e9taire indiqu\u00e9s par ce dernier dans son Annonce qualifi\u00e9e et de v\u00e9rifier le contenu de la Commande<\/u><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Apr\u00e8s avoir confirm\u00e9 le contenu de sa Commande et accept\u00e9 son obligation de paiement de la Commande, le Client validera d\u00e9finitivement sa Commande par son paiement effectif. La Commande ne sera valide et prise en compte qu\u2019\u00e0 compter de l\u2019acceptation de la Commande par le Propri\u00e9taire et du paiement du prix. Le paiement sera effectu\u00e9 par l\u2019interm\u00e9diaire de l\u2019Etablissement de paiement.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client est inform\u00e9 de l\u2019acceptation de la Commande par le Propri\u00e9taire par l\u2019envoi d\u2019un courriel de confirmation de Commande. Le Propri\u00e9taire dispose de quarante-huit (48) heures ouvr\u00e9es pour accepter la Commande. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Site communique ensuite par courriel au Client l\u2019acceptation ou le d\u00e9faut de r\u00e9ponse du Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">A la confirmation par le Propri\u00e9taire, le Client est d\u00e9bit\u00e9 par le Site du montant de la location.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">A d\u00e9faut de r\u00e9ponse du Propri\u00e9taire dans un d\u00e9lai de quarante-huit (48) heures ouvr\u00e9es, le Client n\u2019est en aucun cas d\u00e9bit\u00e9 du montant de la Commande qui est alors automatiquement annul\u00e9e.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA se r\u00e9serve le droit de bloquer la commande du Client dans l&rsquo;hypoth\u00e8se o\u00f9 le d\u00e9bit n&rsquo;a pas \u00e9t\u00e9 possible.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>3.2.2. Gestion des Commandes&nbsp;<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cr\u00e9ant un Compte Client, le Client pourra suivre et g\u00e9rer ses Commandes en cours. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client pourra acc\u00e9der \u00e0 l\u2019historique de l\u2019ensemble de ses Commandes.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client a la possibilit\u00e9 de contacter directement le Propri\u00e9taire, par le biais de la messagerie disponible sur son Compte Client, une fois la commande pass\u00e9e aupr\u00e8s du Propri\u00e9taire.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les questions du Client pourront porter sur le Bien immobilier lui-m\u00eame, ou tout autre motif.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La r\u00e9ponse du Propri\u00e9taire pourra \u00eatre consult\u00e9e par le Client, sur son Compte Client.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Seuls le Propri\u00e9taire et le Client sont responsables du contenu de leurs communications.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>4. SPECIFICATIONS TECHNIQUES<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Pour acc\u00e9der \u00e0 son Compte Client et pouvoir suivre ses commandes en cours, le Client doit \u00eatre \u00e9quip\u00e9 de tous les outils n\u00e9cessaires, notamment les outils informatiques et logiciels ad\u00e9quats. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les acc\u00e8s au Compte Client sont plac\u00e9s sous la seule garde et la seule responsabilit\u00e9 du Client et se font au moyen d\u2019Identifiants. Pour des raisons de s\u00e9curit\u00e9, le Client s\u2019interdit de communiquer ses Identifiants \u00e0 des tiers.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les \u00e9quipements n\u00e9cessaires \u00e0 l\u2019acc\u00e8s et \u00e0 l\u2019utilisation du Site sont \u00e0 la charge du Client, de m\u00eame que les frais de t\u00e9l\u00e9communications \u00e9ventuellement induits par leur utilisation.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il incombe au Client de prot\u00e9ger ses \u00e9quipements techniques notamment contre toute forme de contamination par des virus et\/ou de tentative d&rsquo;intrusion et d\u2019effectuer toutes sauvegarde de ses donn\u00e9es, <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ou le Propri\u00e9taire ne pouvant en \u00eatre tenus pour responsable.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Client est seul responsable de l&rsquo;utilisation qu\u2019il peut faire des services propos\u00e9s et ne saurait tenir responsable <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ou le Propri\u00e9taire pour toute r\u00e9clamation et\/ou proc\u00e9dure faite \u00e0 son encontre.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Par ailleurs, le Client s\u2019engage \u00e0 faire son affaire personnelle de toute r\u00e9clamation et\/ou proc\u00e9dure form\u00e9e contre le Propri\u00e9taire et\/ou <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">et qui se rattacherait \u00e0 son utilisation du service.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ou le Propri\u00e9taire se r\u00e9servent le droit d&rsquo;apporter \u00e0 leurs services toutes les modifications et am\u00e9liorations qu&rsquo;ils jugeront n\u00e9cessaires ou utiles et ne seront pas responsables des dommages de toute nature pouvant survenir de ce fait. Par ailleurs, <\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"> ou le Propri\u00e9taire se r\u00e9servent le droit, sans pr\u00e9avis ni indemnit\u00e9, d&rsquo;arr\u00eater temporairement ou d\u00e9finitivement un service ou l&rsquo;ensemble des services propos\u00e9s par chacun d\u2019eux sur le Site. Ils ne seront pas responsables des dommages de toute nature pouvant survenir de ce fait.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>5. ROLE DE GRINTOURA<\/b><\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Site consiste \u00e0 mettre en relation, par voie \u00e9lectronique, les Clients et les Propri\u00e9taires en vue de la location de Biens immobiliers. GRINTOURA agit comme interm\u00e9diaire et op\u00e9rateur de plateforme en ligne.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Site donne \u00e9galement acc\u00e8s aux Utilisateurs \u00e0 des Annonces sur des produits ou des services. Lesdites produits et services ne sont pas commercialis\u00e9s via le Site.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il est pr\u00e9cis\u00e9 au Client que GRINTOURA n\u2019exerce aucun contr\u00f4le sur la r\u00e9alisation des locations de Biens immobiliers et n\u2019intervient pas dans la transaction op\u00e9r\u00e9e entre le Client et le Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le contrat de location entre le Propri\u00e9taire et le Client est donc conclu exclusivement et directement entre le Client et le Propri\u00e9taire, GRINTOURA intervenant comme simple interm\u00e9diaire technique.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Annonces, les Annonces qualifi\u00e9es et l\u2019ensemble des indications sur les prix et les descriptions des Biens immobiliers sont \u00e9tablies exclusivement par les Propri\u00e9taires ou les \u00e9diteurs desdites Annonces et restent sous leur enti\u00e8re responsabilit\u00e9.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En tant qu\u2019op\u00e9rateur de plateforme en ligne, GRINTOURA agit de mani\u00e8re neutre et transparente.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Il est pr\u00e9cis\u00e9 que GRINTOURA n\u2019entretient aucun lien capitalistique ou de quelconque d\u00e9pendance juridique avec les Propri\u00e9taires r\u00e9f\u00e9renc\u00e9s sur le Site de nature \u00e0 influencer le classement ou le r\u00e9f\u00e9rencement des Annonces ou des Annonces qualifi\u00e9es.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les Annonces et les Annonces qualifi\u00e9es sur le Site sont pr\u00e9sent\u00e9es par le biais d\u2019un moteur de recherche th\u00e9matique fonctionnant gr\u00e2ce \u00e0 des mots clefs. <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Lors de la recherche dans le moteur de recherche, le classement des Annonces et des Annonces qualifi\u00e9es propos\u00e9es se fait de fa\u00e7on al\u00e9atoire \/ peut se faire selon divers param\u00e8tres tels que la pertinence ou le prix.<!-- A valider --><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>6. OBLIGATIONS DE GRINTOURA<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L\u2019obligation g\u00e9n\u00e9rale de GRINTOURA est une obligation de moyens. Il ne p\u00e8se sur GRINTOURA aucune obligation de r\u00e9sultat ou de moyens renforc\u00e9e d\u2019aucune sorte.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA s\u2019engage \u00e0 mettre tous les moyens en \u0153uvre pour assurer une continuit\u00e9 d\u2019acc\u00e8s et d\u2019utilisation du Site 7 jours sur 7 et 24 heures sur 24.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA attire toutefois l\u2019attention du Client sur le fait que les connaissances techniques actuelles ne permettent pas d\u2019assurer de mani\u00e8re certaine et continue la transmission des \u00e9changes \u00e9lectroniques (messages, documents, identit\u00e9 de l\u2019\u00e9metteur ou du destinataire).&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En qualit\u00e9 d\u2019op\u00e9rateur de plateforme en ligne, GRINTOURA entend se soumettre aux dispositions des articles L.111-7 et suivants du Code de la consommation et ainsi fournir une information claire transparente et loyale sur le Site. &nbsp;&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>7. OBLIGATIONS DU CLIENT <\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans le cadre de l\u2019utilisation du Site, chaque Client s\u2019engage \u00e0 ne pas porter atteinte \u00e0 l\u2019ordre public et \u00e0 se conformer aux lois et r\u00e8glements en vigueur, \u00e0 respecter les droits des tiers et les dispositions des pr\u00e9sentes CGU Client.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Chaque Client a pour obligation de :<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">se comporter de fa\u00e7on loyale et licite \u00e0 l\u2019\u00e9gard de GRINTOURA et des tiers ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00eatre honn\u00eate et sinc\u00e8re dans les informations fournies \u00e0 GRINTOURA et, le cas \u00e9ch\u00e9ant aux tiers Utilisateurs&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">utiliser le Site conform\u00e9ment \u00e0 son objet tel que d\u00e9crit dans les pr\u00e9sentes CGU ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ne pas d\u00e9tourner la finalit\u00e9 du Site pour commettre des crimes, d\u00e9lits ou contraventions r\u00e9prim\u00e9s par le Code p\u00e9nal ou par toute autre loi ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ne pas r\u00e9aliser d\u2019extraction substantielle ou r\u00e9p\u00e9t\u00e9e du contenu du Site en portant atteinte aux droits de producteur de base de donn\u00e9es de GRINTOURA&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">respecter la vie priv\u00e9e des tiers et la confidentialit\u00e9 des \u00e9changes ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">respecter les droits de propri\u00e9t\u00e9 intellectuelle de GRINTOURA portant sur les \u00e9l\u00e9ments du Site et le cas \u00e9ch\u00e9ant, les droits de propri\u00e9t\u00e9 intellectuelle des autres Utilisateurs ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ne pas chercher \u00e0 porter atteinte au sens des articles 323-1 et suivants du Code p\u00e9nal aux syst\u00e8mes de traitements automatis\u00e9s de donn\u00e9es mis en \u0153uvre sur le Site, notamment par l\u2019interm\u00e9diaire de pratiques telles que le scrapping ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ne pas modifier les informations mises en ligne par GRINTOURA ou par un autre Utilisateur ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ne pas utiliser le Site pour envoyer massivement des messages non sollicit\u00e9s (publicitaires ou autres) ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ne pas diffuser des donn\u00e9es ayant pour effet de diminuer, de d\u00e9sorganiser, de ralentir ou d\u2019interrompre le fonctionnement normal du Site.&nbsp;<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Dans le respect des dispositions l\u00e9gales et r\u00e9glementaires en vigueur et conform\u00e9ment \u00e0 la loi du 29 juillet 1881 relative \u00e0 la libert\u00e9 de la presse, le Client s\u2019engage \u00e0 ne pas diffuser de d\u00e9nigrement fautif visant GRINTOURA ou les Utilisateurs du Site ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">contraires \u00e0 l\u2019ordre public et aux bonnes m\u0153urs.&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00e0 caract\u00e8re injurieux, diffamatoire, raciste, x\u00e9nophobe, r\u00e9visionniste ou portant atteinte \u00e0 l&rsquo;honneur ou \u00e0 la r\u00e9putation d&rsquo;autrui ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">incitant \u00e0 la discrimination, \u00e0 la haine d&rsquo;une personne ou d&rsquo;un groupe de personnes \u00e0 raison de leur origine ou de leur appartenance ou de leur non-appartenance \u00e0 une ethnie, une nation, une race ou une religion d\u00e9termin\u00e9e ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">mena\u00e7ant une personne ou un groupe de personnes&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">incitant \u00e0 commettre un d\u00e9lit, un crime ou un acte de terrorisme ou faisant l&rsquo;apologie des crimes de guerre ou des crimes contre l&rsquo;humanit\u00e9 ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">incitant au suicide ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">permettant \u00e0 des tiers de se procurer directement ou indirectement des logiciels pirat\u00e9s, des num\u00e9ros de s\u00e9rie de logiciels, des logiciels permettant des actes de piratage et d&rsquo;intrusion dans les syst\u00e8mes informatiques et de t\u00e9l\u00e9communications, des virus et autres bombes logiques et d&rsquo;une mani\u00e8re g\u00e9n\u00e9rale tout outil logiciel ou autre permettant de porter atteinte aux droits d&rsquo;autrui et \u00e0 la s\u00e9curit\u00e9 des personnes et des biens ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">\u00e0 caract\u00e8re commercial (prospection, racolage, prostitution\u2026).<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>8. STATUT D\u2019HEBERGEUR DE <\/b><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>GRINTOURA<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Tout Client reconnait que GRINTOURA a la qualit\u00e9 d\u2019h\u00e9bergeur au sens de l\u2019article 6 I 2\u00b0 de la loi du 21 juin 2004 pour la confiance dans l\u2019\u00e9conomie num\u00e9rique.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La notification des contenus manifestement illicites par un Utilisateur, Client, Propri\u00e9taire ou tout autre tiers doit se faire par courriel \u00e0 l\u2019adresse : reclamations@grintoura.fr &nbsp;&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">ou par courrier en recommand\u00e9 avec avis de r\u00e9ception \u00e0 : Grintoura 13 rue des faisans 67370 Truchtersheim en indiquant les \u00e9l\u00e9ments list\u00e9s sou l\u2019article 6 I 5\u00b0 de la loi du 21 juin 2004.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>9. RESPONSABILITE<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire assume l&rsquo;enti\u00e8re responsabilit\u00e9 en ce qui concerne les Biens immobiliers qu&rsquo;il met en location par le biais du Site et traitera seul les r\u00e9clamations relatives aux Biens immobiliers.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Par ailleurs, GRINTOURA \u00e9tant seulement un interm\u00e9diaire entre le Propri\u00e9taire et le Client, cette derni\u00e8re d\u00e9cline toute responsabilit\u00e9 relative \u00e0 la location conclue entre le Propri\u00e9taire et le Client sur le Site. Ainsi, le Client exon\u00e8re GRINTOURA de toute responsabilit\u00e9 qui pourrait survenir dans l&rsquo;ex\u00e9cution de la location.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">GRINTOURA ne peut en aucun cas \u00eatre tenu responsable dans les cas suivants&nbsp;: <\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">acc\u00e8s temporairement impossible au Site pour des op\u00e9rations de maintenance technique ou d\u2019actualisation des informations publi\u00e9es. Le Client reconnait que la responsabilit\u00e9 de GRINTOURA ne saurait \u00eatre engag\u00e9e en cas de dysfonctionnements ou d\u2019interruptions desdits r\u00e9seaux de transmission ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">utilisation anormale ou exploitation illicite du Site par un Utilisateur ou un tiers ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">affichages de contenus de sites internet tiers vers lesquels renvoient des liens hypertextes pr\u00e9sents sur le Site ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">non-respect des pr\u00e9sentes CGU imputable aux Utilisateurs ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">retard ou inex\u00e9cution de ses obligations, lorsque la cause du retard ou de l\u2019inex\u00e9cution est li\u00e9e \u00e0 un cas de force majeure telle qu\u2019elle est d\u00e9finie \u00e0 l\u2019article 10 des pr\u00e9sentes CGU ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">attaques virales, intrusion illicite dans un syst\u00e8me de traitement automatis\u00e9 de donn\u00e9es ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">cause \u00e9trang\u00e8re non imputable \u00e0 GRINTOURA&nbsp;;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas d\u2019agissement illicite d\u2019un Client, ou d\u2019inex\u00e9cution contractuelle dont un Client se serait rendu auteur dans le cadre de la location du Bien immobilier ;&nbsp;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">De tout probl\u00e8me rencontr\u00e9 lors de l\u2019ex\u00e9cution de la Commande par le Propri\u00e9taire.&nbsp;<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">En cas d\u2019utilisation anormale ou d\u2019une exploitation illicite du Site, l\u2019Utilisateur en cause est alors seul responsable des dommages caus\u00e9s aux tiers et des cons\u00e9quences des r\u00e9clamations ou actions qui pourraient en d\u00e9couler.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><b>10. FORCE MAJEURE<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">La responsabilit\u00e9 du Client ou de GRINTOURA ne pourra pas \u00eatre mise en \u0153uvre si la non-ex\u00e9cution ou le retard dans l\u2019ex\u00e9cution de l\u2019une de leurs obligations d\u00e9crites dans les pr\u00e9sentes CGU d\u00e9coule d\u2019un cas de force majeure au sens que lui donne la jurisprudence.&nbsp;<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Si l\u2019emp\u00eachement est temporaire, l\u2019ex\u00e9cution de l\u2019obligation est suspendue \u00e0 moins que le retard qui en r\u00e9sulterait ne justifie la r\u00e9solution du contrat. Ces informations et donn\u00e9es personnelles sont \u00e9galement conserv\u00e9es \u00e0 des fins de s\u00e9curit\u00e9, afin de respecter les obligations l\u00e9gales et r\u00e9glementaires. Elles seront conserv\u00e9es pendant trois ans.<\/span><\/span> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Les factures li\u00e9es aux locations de Biens immobiliers sont conserv\u00e9es 10 ans.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le responsable du traitement des donn\u00e9es est GRINTOURA<\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\"><i>. <\/i><\/span><\/span><span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">L&rsquo;acc\u00e8s aux donn\u00e9es personnelles sera strictement limit\u00e9 aux employ\u00e9s du responsable de traitement, habilit\u00e9s \u00e0 les traiter en raison de leurs fonctions. Traitements r\u00e9alis\u00e9s par le Propri\u00e9taire<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><a name=\"_Hlk97720677\"><\/a> <span style=\"font-family: Arial Nova Light, serif;\"><span style=\"font-size: small;\">Le Propri\u00e9taire peut \u00eatre amen\u00e9 \u00e0 collecter et traiter les donn\u00e9es \u00e0 caract\u00e8re personnel des Clients ayant pass\u00e9 Commande aupr\u00e8s de lui \u00e0 partir du Site pour les seuls besoins de l\u2019ex\u00e9cution de la Commande concern\u00e9e. Il pourra \u00e9galement conserver les donn\u00e9es des Clients afin de r\u00e9pondre \u00e0 ses obligations l\u00e9gales, notamment fiscales et comptables, ou pour g\u00e9rer les \u00e9ventuels litiges avec ces Clients. Ce syst\u00e8me est facilement accessible et gratuit et garantit un traitement dans un d\u00e9lai raisonnable. GRINTOURA prendra en consid\u00e9ration les r\u00e9clamations d\u00e9pos\u00e9es et assurera le suivi \u00e9ventuellement n\u00e9cessaire afin de r\u00e9soudre le probl\u00e8me soulev\u00e9 de mani\u00e8re appropri\u00e9e.
